This agreement is between you (the “traveller”) and Rahi Trek & Travels, Dehradun, Uttarakhand (“we”, “us”). You accept it when you confirm a booking. We keep a copy of the exact wording you accepted, attached to your booking.
Please read it before you pay. If anything here is unclear, ask us first — we would much rather answer a question than have you agree to something you did not understand.
1. Who can book
- You must be at least [DECIDE: minimum age, e.g. 18] to make a booking. Travellers under [DECIDE: minimum age to trek, e.g. 14] may join only with a parent or guardian on the same trek.
- If you book for other people, you confirm you have their permission, that the details you gave us for each of them are accurate, and that you have shared this agreement with them. Everyone on the booking is bound by it.
2. Booking and confirmation
- A booking is not confirmed until we have received payment and told you so. Until then your seats are held, not guaranteed.
- The price shown at the time of booking is the price we honour for that booking, even if the trek price changes later.
- Places on a departure are limited. Where a departure needs a minimum number of travellers to run, that number is [DECIDE: minimum group size, or delete this point if not applicable].
3. Payment
Payment amounts, timing and accepted methods are set out in our Payment Terms. Cancellations, changes and refunds are governed by our Cancellation Policy and Refund Policy. Those documents form part of this agreement.
4. Your fitness
Himalayan trekking is physically demanding. By booking you confirm that:
- you have read the fitness and preparation guidance on the trek’s page, and you believe you can complete the trek as described;
- you have prepared for it, and you understand that arriving unprepared puts you and the rest of the group at risk;
- you will tell us promptly if your fitness or health changes before departure.
5. Medical disclosure
- You must tell us, in writing and before the trek, about any medical condition, injury, allergy, pregnancy or medication that could affect your safety or ours — including asthma, heart conditions, diabetes, epilepsy, blood pressure conditions and any previous altitude illness.
- We treat this information confidentially and use it only to keep you safe. See our Privacy Policy.
- If you withhold something material, we may stop you joining or continuing the trek, and the cancellation terms will apply as if you had cancelled.
6. Altitude, weather and the nature of the risk
This is the most important section of this agreement, so we have written it plainly.
- Trekking at altitude carries risks that cannot be removed, however carefully a trek is run. These include altitude sickness (including HAPE and HACE), falls, rockfall, avalanche, sudden weather change, cold injury, river crossings, difficult or unmarked terrain, animal encounters, illness from food or water, and delay or difficulty in reaching medical help.
- Remote areas mean help can be hours or days away. Mobile coverage is often absent. Evacuation depends on terrain, weather and available transport, and cannot be guaranteed or scheduled.
- You accept these risks voluntarily, and you take part at your own risk.
7. The trek leader’s authority
- Our trek leader has final authority on the trail. You agree to follow their instructions on route, pace, timing, rest, camp discipline and turning back.
- The leader may change or shorten the route, or end your trek or the group’s trek, if in their judgement it is unsafe to continue — because of weather, trail conditions, altitude symptoms, illness, injury, or the condition of the group.
- The leader may require you to descend, or to stop trekking, if they believe continuing puts you or others at risk. This decision is not negotiable on the mountain, and any costs of your descent or early return are yours.
- If you leave the group against the leader’s advice, you do so entirely at your own risk and we are not responsible for what follows.
8. Insurance
Travel and medical insurance covering trekking at the altitudes involved, including emergency evacuation, is [DECIDE: mandatory / strongly recommended]. We do not provide insurance, and we are not responsible for medical, evacuation, repatriation or loss costs you incur.
9. Permits, identification and the law
- Many of our routes require forest, park or state permits. You must carry valid government photo identification and provide the details we ask for in advance. Permit requirements are set by the authorities, not by us, and can change at short notice.
- Entry can be refused by the authorities for reasons outside our control. Where that happens we will do what we reasonably can, but it is treated as a cancellation by circumstance, not by us.
- You agree to obey Indian law and local regulations, including rules on protected areas, waste, firewood and wildlife.
10. Conduct and the group
- Treks are run in small groups and depend on people looking out for one another. You agree to behave with consideration for the group, our staff and the communities and places we pass through.
- Illegal drugs are not permitted. Alcohol is not permitted on the trail or at altitude.
- We may remove you from a trek, without refund, for behaviour that is unsafe, abusive, or that seriously affects other travellers or our staff.
- Please carry your waste out with you. Leave the trail as you found it.
11. Changes we may have to make
- Mountain conditions decide a great deal. We may change the route, campsites, accommodation, schedule or inclusions where safety, weather, permits, or circumstances beyond our control require it. We will always try to keep the character of the trek.
- We may cancel a departure for safety reasons, for insufficient numbers, or for events beyond our reasonable control (including weather, natural events, strikes, road closures, government or authority action, and public health restrictions). Where we cancel, our Cancellation Policy sets out what you are entitled to.
- A change of route or itinerary for safety reasons is not a failure to deliver the trek, and does not by itself entitle you to a refund.
12. Your belongings
You are responsible for your own equipment, documents, money and valuables throughout the trek, including in vehicles, tents, lodges and left luggage. We are not liable for loss or damage to them.
13. Photographs
We may take photographs and video on our treks and use them to describe our trips. If you would prefer not to appear in anything we publish, tell us before or during the trek and we will respect that.
14. Our responsibility
- We will organise and run your trek with reasonable skill and care.
- We are not responsible for loss, injury, delay or expense caused by circumstances beyond our reasonable control, or arising from your own acts, omissions, health, fitness, or failure to follow instructions.
- Where we are found liable, our liability is limited to the amount you paid us for the trek, except where the law does not allow that limit.
- Nothing in this agreement limits any liability that cannot lawfully be limited.
15. Your data
We collect only what a trek reasonably requires — contact details, traveller names and ages, identification for permits, and any medical information you disclose. How we handle it is set out in our Privacy Policy.
16. Governing law
This agreement is governed by the laws of India. Disputes are subject to the jurisdiction of the courts at Dehradun, Uttarakhand.
By confirming a booking you acknowledge that you have read this agreement, that you accept the risks described in it, and that you agree to it on behalf of everyone on your booking.
